Acceptance of terms
This page (together with the documents referred to on it) tells you the Terms & Conditions on which you may make use of the lifeandhome.co.uk website (the “Site”), and the terms applicable to the sale of goods or services through the Site.
Please read these Terms and Conditions carefully before ordering any products from our Sellers via our site.  You should understand that by ordering products via our site you agree to be bound by these Terms and Conditions. You should print a copy of these Terms and Conditions for your reference
We may update these Terms & Conditions from time to time and will notify such changes to you by uploading them on the Site. You should review the Terms & Conditions periodically for changes.
1. About us
The Site is operated by Lifeandhome.co.uk, Isell Ltd (”we”). We are registered in England and Wales under company number 5591328 and with our registered office address at 104 Queens Road, Ashton Under Lyne, Lancashire.
2. Accessing our site
Our site is only intended for use by people resident in the Services Countries of England, Scotland and Wales.  Our Sellers do not accept orders from individuals outside those countries.

Access to the Site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on the Site without notice. We will not be liable if for any reason the Site is unavailable at any time or for any period.
From time to time, we may restrict access to some parts of the Site. Any personal data and other information provided by you is processed by us in accordance with our Privacy Policy. By providing any such personal data or other information you agree to the terms of our Privacy Policy.
If you choose, or you are provided with, a user identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential, and you must not disclose it to any third party. We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our opinion you have failed to comply with any of the provisions of these Terms & Conditions.

If you breach these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

4. Description of Lifeandhome.co.uk service
Please note that we accept orders as agents on behalf of our Sellers. The resulting legal contract is between you and that Seller, and is subject, in addition to these Terms & Conditions to the terms and conditions of that Seller, which they will advise you of directly. You should carefully review their terms and conditions applying to the transaction.
We cannot give any undertaking, that goods or services you purchase from Sellers  through the Site will be of satisfactory quality, and any such warranties are DISCLAIMED by us absolutely. This DISCLAIMER does not affect your statutory rights against the third party seller. Where you order goods or services through the Site we may disclose your customer information related to that transaction to the relevant Seller.
We do not review or control, and are not responsible in any way for, listings provided by Seller and at no time do we possess any items offered for sale through the Site.
5. How contracts are formed between you and Sellers
Each order you place shall be deemed to be an offer by you to purchase the goods and/or services specified within it subject to these Terms & Conditions and any additional terms and conditions notified to you by the Seller.
No order shall be deemed to be accepted by the Seller until the Seller issues an email acknowledgement of order.
The contract will relate only to those goods and/or services notified in the email acknowledgement of order.
6. Your Status
By placing an order via through our site, you warrant that:
(a) You are legally capable of entering into binding contracts; [and]
(b) You are at least 18 years old:
(c ) You are resident in one of the Serviced Countries; and
(d) You are accessing our site from that country.
7.  Payment methods
Purchases may be paid for by using a debit or credit card through Protx, our online payment facility. All prices are in pounds sterling (£), and are payable in pounds sterling (£), plus any applicable taxes.
7. Refusal of transaction
We may refuse to process a transaction for any reason or refuse service to anyone at any time at our sole discretion. We will not be liable to you or any third party by reason of so refusing or by reason of unwinding or suspending any transaction after processing has begun.
8. Delivery arrangements
Your shopping basket on the Site displays the goods you have chosen, the Seller who will supply them and details of post and packing. The delivery costs for each Seller vary according to the delivery methods they offer. Any delivery times quoted are estimates only, based on availability and normal delivery time in working days.
9. Import duty
If you order goods from our Site for delivery outside the UK, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and taxes. Please note that we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.
Please also note that you must comply with all applicable laws and regulations of the country for which the products are destined. We will not be liable for any breach by you of any such laws.
10. Consumer Rights
If you are contracting as a consumer, you may cancel a Contract with our Seller at any time within seven working days, beginning on the day after you received the Products.  In this case you will receive a full refund of the price paid for the Products in accordance with Returns policy in clause 11 below.
You must return the Product(s) to the Seller immediately, in the same condition in which you received them and at your own cost and risk.  You have a legal obligation to take reasonable care of the Products while they are in your possession.
11.Returns
If you wish to discuss or organise a return, exchange or refund of any item, please contact the seller (the supplier) concerned. Their details are provided on your order confirmation email and on the ‘Returns Form’ if included with the goods. You should be able to reach an amicable agreement with one another and If necessary, you can return your item to the supplier for a refund.
Goods must be returned to the Seller in the same condition in which they were received at your own cost and risk.
There are naturally exceptions to the terms shown above, where for instance products are specially made, so please always double check the returns policy directly with the Seller concerned.
Please note that certain items are likely to be non returnable/refundable
Items that are made to order, or personalised
Perishable products, including food and flowers
Personal products such as underwear, jewellery (especially earrings), cosmetics
Large items of furniture which are often specially made or ordered

11. Links
Our Site must not be framed on any other website, nor may you create a link to any part of our Site.
The Site provides links to other websites for your information. We have no control over such sites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them.
12. Viruses, hacking and other offences
You must not misuse our site by knowingly introducing viruses, Trojans, worms, logic bombs or other material which is malicious or technologically harmful. You must not attempt to gain unauthorised access to our Site, the server on which our Site is stored or any server, computer or database connected to our Site. You must not attack our Site via a denial-of-service attack or a distributed denial-of-service attack.
By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our Site will cease immediately.
We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of our Site or to your downloading of any material posted on it, or on any website linked to it.
13. Waiver
If we fail at any time to insist upon strict performance of any of your obligations under these Terms & Conditions, or if we fail to exercise any of the rights or remedies to which we are entitled under them, this shall not constitute a waiver of such rights or remedies and shall not relieve you from compliance with such obligations.
A waiver by us of any default shall not constitute a waiver of any subsequent default.
No waiver by us of any of these Terms & Conditions shall be effective unless it is expressly stated to be a waiver and is communicated to you in writing.
14. Severability
If any of these Terms & Conditions are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
15. Entire agreement
These Terms & Conditions and any document expressly referred to in them represent the entire agreement between us and supersede any prior agreement, understanding or arrangement between us, whether oral or in writing.
16. Force majeure
Where a Seller is prevented from or delayed in the carrying on of its business due to circumstances beyond its reasonable control including, without limitation, acts of God, governmental actions, war or national emergency, riot, civil commotion, fire, explosion, flood, epidemic, lock-outs, strikes or other labour disputes (whether or not relating to the Member Partner’s workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials the date of delivery shall be postponed for the period that the circumstances continue.
17. Law and jurisdiction
Contracts for the purchase of Goods through our site will be governed by English law. Any dispute arising from, or related to, such Contracts shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
